The U.S. Department of Homeland Security (DHS) told The Tennessee Star on Monday that Jerson Diaz-Diaz, the 22-year-old man who was arrested last month after he allegedly posed as a 16-year-old in order to sexually exploit a teenage girl in Nashville, illegally entered the United States in 2021 and was released by the Biden administration.
Confirming that U.S. Immigration and Customs Enforcement (ICE) filed a detainer to block his release, a DHS spokesperson told The Star that Diaz-Diaz is an illegal alien from Honduras.
The spokesperson said Diaz-Diaz illegally entered the United States through Texas and was stopped by U.S. Border Patrol in March 2021, shortly after former President Joe Biden began his term in the White House. After stopping the alien, DHS told The Star that Biden-era immigration officials released Diaz-Diaz into the interior of the country.
“This illegal alien is accused of raping a teenage girl after lying about his age to her,” DHS Secretary Markwayne Mullin said in a statement obtained by The Star.
“Had it not been for the Biden Administration’s open borders, this predator would not have been allowed into our country and this horrible crime never would have happened,” stated Mullin.
“ICE has lodged a detainer with Davidson County, Tennessee, asking officials there to cooperate with us and make sure this criminal never gets back out onto the streets.”
Diaz-Diaz (pictured above) reportedly admitted during police interviews that he knew the girl was a minor and intentionally lied about his age during communications that began in August, according to WSMV 4.
The outlet reported Diaz-Diaz was charged with statutory rape and sexual exploitation of a minor, but additionally indicated that the defendant possessed a “sexually exploitative video” of the minor on his cell phone. The Star could not find evidence that Diaz-Diaz was charged with producing such materials.
In January, the Tennessee District Attorneys General Conference (TNDAGC) released its annual report of criminal convictions and charges against illegal aliens, revealing that local law enforcement throughout Tennessee reported 145 sexual offenses in 2025. Of these 145 sexual crimes committed by illegal aliens, the TNDAGC report said at least 79 included minor victims.
According to the TNDAGC report, more than 11,000 illegal aliens were charged or convicted of committing crimes in Tennessee last year.
Last month, DHS reported more than 120 illegal aliens were arrested during an ICE operation at a Memphis nightclub.
